Terms of Use and
Software License

Effective August 24, 2026

These Terms are a binding agreement between you and Cem Bas, doing business as TermiSec, and govern the website and TermiSec macOS software.

1. Acceptance

By selecting “I agree and download,” installing, accessing, or using TermiSec, you agree to these Terms and the Privacy Policy. If you use TermiSec for an organization, you represent that you have authority to bind that organization. If you do not agree, do not download or use TermiSec.

2. License grant

Subject to these Terms, TermiSec grants you a limited, non-exclusive, non-transferable, revocable license to install and use the object-code version of TermiSec on Apple-branded computers you control for personal or internal business purposes. This license does not transfer ownership. TermiSec and its original components remain the property of Cem Bas.

Third-party components are licensed under their respective terms. Those licenses control if they conflict with this license for the applicable component. See the third-party notices distributed with the project or product.

3. Restrictions

You may not:

  • sell, sublicense, rent, or distribute TermiSec except as expressly permitted in writing;
  • remove copyright, license, attribution, or proprietary notices;
  • circumvent technical protections or use TermiSec to violate law or another person's rights;
  • misrepresent TermiSec scan results as a certification, audit, or guarantee of safety; or
  • reverse engineer or modify proprietary portions except to the extent applicable law expressly permits that activity despite this restriction.

4. Security-tool limitations

TermiSec reduces certain risks by scanning for deterministic patterns and running code inside a disposable virtual machine. It does not prove that a repository, dependency, command, recruiter, developer, or destination is trustworthy or safe. It may miss harmful behavior, flag legitimate behavior, fail to isolate a workload, or contain vulnerabilities.

You are responsible for reviewing findings, commands, network destinations, downloaded code, and output; maintaining backups; protecting credentials; and deciding whether to proceed. TermiSec is not a substitute for professional security review, endpoint security, organizational controls, or sound engineering judgment.

5. Network commands and third parties

The runtime is offline by default, but you may approve commands that communicate with third-party services. Those services and repositories are not controlled by TermiSec. Their content, availability, security, and terms are their responsibility. You are solely responsible for data sent by commands you run and for complying with third-party terms.

6. Public beta, updates, and support

TermiSec is a free public beta. Features, compatibility, security rules, and availability may change or stop without notice. Updates may be required for continued use. No service level, maintenance commitment, or support response time is promised. Feedback may be used without restriction or compensation, but you retain ownership of any underlying work you identify as yours.

7. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERMISEC AND THE WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AVAILABILITY, OR THAT TERMISEC WILL DETECT, BLOCK, OR CONTAIN HARMFUL CODE.

Some jurisdictions do not allow certain disclaimers, so the exclusions above apply only to the extent permitted by law. Nothing in these Terms limits non-waivable consumer rights.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CEM BAS AND TERMISEC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, CREDENTIALS, PROFITS, REVENUE, BUSINESS, GOODWILL, OR SECURITY INCIDENTS, ARISING FROM OR RELATED TO TERMISEC, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

To the maximum extent permitted by law, total liability for all claims arising from or relating to TermiSec will not exceed the greater of US $100 or the amount you paid for TermiSec during the 12 months before the event giving rise to the claim. These limitations do not apply to liability that cannot lawfully be limited, including liability for fraud, intentional misconduct, or gross negligence where applicable.

9. Termination

You may terminate this agreement by stopping use and deleting all copies of TermiSec. The license terminates automatically if you materially breach these Terms. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, and dispute terms—remain effective after termination.

10. Governing law and disputes

These Terms are governed by California law, without regard to conflict-of-law rules. Except where applicable law gives you another right, state and federal courts located in San Diego County, California will have exclusive jurisdiction. Before filing a claim, each party agrees to send written notice and attempt in good faith to resolve the dispute informally for 30 days.

11. General terms

These Terms and the Privacy Policy are the entire agreement about TermiSec and supersede prior statements on that subject. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without written consent; TermiSec may assign them as part of a reorganization or transfer of the product. Headings are for convenience only.

Material changes will be posted with a revised effective date. If a change materially affects the license or your obligations, acceptance may be requested again. Questions may be sent to cem@tokensurf.io.
